Hidden defects when buying a Swedish house: what you can actually claim

"Hidden defect" is one of the most misunderstood concepts in Swedish property purchases. A defect is not hidden just because you did not see it β€” it is hidden only if you could not reasonably have discovered it through a sufficiently thorough investigation.

The duty to investigate sets the boundary

Under the Land Code the buyer has a far-reaching duty to investigate. The older the house and the more warning signs present, the further that duty extends.

If the report recommends further technical investigation and you ignore it, the defect is effectively no longer hidden. That is the most common reason claims fail.

What the seller is liable for

The seller is liable for ten years for defects that existed at purchase, that you could not reasonably have discovered, and that you had no reason to expect given the age and condition of the house.

A leaking 50-year-old roof is rarely a hidden defect β€” it is expected wear. A badly built wet-room structure behind new tiling may well be.

Document before you sign

Keep the listing, the seller's disclosure form, the inspection report, your email thread with the agent and your own photos from the viewing. That documentation decides any claim years later.
